HHS Relaxes Security and Transparency Rules for Electronic Health Records

The federal government has removed 14 security, privacy, and transparency requirements for vendors of electronic health records. According to reporting by Casey Ross of STAT, the administrative action aims to streamline regulations and support the development of new health care technologies.

Changes to Certification Standards

A final rule issued by the Office of the National Coordinator for Health IT eliminated 14 out of 60 criteria currently used to certify electronic record-keeping systems sold by major technology companies. In addition to the total removal of these 14 requirements, seven other criteria were substantially revised by federal regulators.

Concerns Raised Over Privacy and Safety

The policy adjustments moved forward despite significant pushback during the public comment period. Commenters expressed concerns that scaling back these standards could:

  • Undermine the security and privacy of sensitive patient health information.
  • Weaken efforts to ensure the safety and reliability of software products that rely on artificial intelligence.
  • Remove critical oversight mechanisms designed to maintain transparency in health technology deployment.

The updated guidelines form part of ongoing efforts by the administration to accelerate innovation within the health technology sector by reducing regulatory burdens on software developers and hospital networks.
